The following terms and conditions govern your ("You" or "Your"
or "passenger" or "tour participant") use of this Web site (the "Site").
Use of the Site is offered to the tour participant conditioned on acceptance by
the tour participant without modification of the terms, conditions and notices
contained herein. Use of the content, services, and/or products presented in
any and all areas of these sites constitutes the tour participant's agreement
to abide by the following Terms and Conditions and those posted in specific
areas of these sites. We may revoke Your ability to use the
Site at any time and for any reason (or no reason).
We may amend these terms and conditions at any
time. All amended Terms and Conditions shall automatically be effective upon
being posted by us to the Site. Accordingly, You should check
the Site frequently for any changes to these Terms and Conditions. These Terms
and Conditions may not be otherwise amended except in a writing signed by an
authorized officer of us and You.
Tour participants will be required to provide notice of the
understanding and acceptance of these Terms & Conditions prior to the
issuance of Final Documents. Acceptance of these Terms & Conditions
constitutes Your Passage Contract.

Prices,
Reservations, Payments and Cancellation Policies:
Prices: Unless otherwise
noted, all prices are per person, based on double occupancy (two guests sharing
a hotel room or cruise stateroom). All prices listed (including tours, air
travel, and optional components) are accurate at time of presentation and
subject to change without notice. Tours including an overnight rail component
provide semi-private, quad-occupancy accommodations.
Items not included in the Published Price: Passport and visa;
vaccinations, cruise port charges/taxes; air travel (unless otherwise noted or
purchased), air taxes, departure taxes and fees; governmental or
quasi-governmental taxes/fees; fuel surcharges; excess baggage charges; health,
accident or travel protection plans. Additionally, all items of a personal
nature including dry-cleaning or laundry; wine or spirits, unless indicated;
meals not otherwise indicated, special menu selections otherwise not included;
optional tours or sightseeing not otherwise indicated. Gratuities for Your
Our Trip Guide or independent Tour Guides; Cruise Guide; or
Cruise crew members are not included. Within China, as in North America,
tipping for these services is customary but entirely at Your discretion.
Reservations and Deposits and Final Payments: A deposit of $200 per
person is required to confirm the Land Tour reservation. Deposit may be
submitted in the form of check or credit card. Final payment should be
submitted by check and is due 90 days prior to departure. Final Payment by
credit card will incur additional charges. Reservations under deposit are
subject to cancellation if final payment is not received by 90 days prior to
departure. In some cases, the securement of confirmed international air
reservations under the Our Land+Air program may require, in
addition to the Land Tour reservation deposit of $200 per person, full payment
of the cost of the international airline ticket. In such cases, cancellations
or changes to the Land+Air tour may result in the partial or total forfeiture
of the international airline ticket.
Final Documents: All passenger information must be received within 45
days of land tour departure date. Final Documents are then sent 21 to 30 days
prior to land tour departure date. For late bookings (reservations confirmed
less than 90 days prior to departure) full payment is required at time of
confirmation and Final Documents are not sent until Final Payment has been
received.
Cancellation or Change Policies: Should You need to cancel Your tour or
any portion thereof, Your cancellation must be received in writing and the
cancellation date will be effective on the date of receipt by
us. Departure date changes are deemed a cancellation of the reservation and
subject to any applicable charges. Passenger name changes or name substitutions
are also deemed a cancellation of the reservation and subject to any applicable
charges. If You have purchased air travel through us and Your
cancellation notice is received by us after Your receipt of final documents and
air tickets, You must return the complete set of final documents and the unused
air tickets to us before Your claim can be processed. There is
no refund for unused portions or unused services of the tour. Cancellation

Tour
Policies:
Baggage & Personal Belongings: We permits one
suitcase per person. Airlines may have additional baggage restrictions; please
check with Your air carrier prior to Your flight. We are not
responsible for loss, theft or damage to baggage and personal belongings. A
protection plan covering lost, stolen, or damaged baggage is available through
us.
Double, Triple & Quad Occupancy: Unless otherwise noted, tour prices are per person, based on Double Occupancy (two guests occupying the accommodation). Triple Occupancy rates are available on most tours. However, on some nights on some tours where overnight train or tent ("ger" or "yurt") accommodations are provided, single occupancy arrangements and private restroom facilities are not available. On these specific overnights, shared occupancy accommodations and restroom facilities are provided. Regretfully, we are unable to offer quad (four person) occupancy rates for our tours.
Health & Medical Advisories: Our tours involve
considerable amounts of walking and, in some cases, considerable exertion. Any
disability requiring special attention must be brought to the attention of
us at the time of booking. Ships utilized for the Yangtze River
tour are not ADA (Americans with Disabilities Act) compliant. Additionally,
hotels, museums, attractions, and tour sites within China may not comply with
North American accessibility standards. Motorcoaches and mini-buses utilized
during Your tour are not equipped with wheelchair ramps nor is their sufficient
space onboard these conveyances for wheelchair storage. If You are disabled we
suggest You travel with a non-disabled companion. We have sole
discretion to decline tour participation to any prospective customer whose
health condition or mobility may affect the safety, health or full
participation of that customer or other tour participants. Additionally, should
a tour participant require or request medical attention during their travel in
China, such attention will be provided by locally available health care
officials and at locally available facilities. In such events, We
will not be responsible for health service costs incurred nor in the
quality of medical care or medical services rendered.
Hotels & Overnight Accommodations: Every reasonable effort will be made to provide the hotel
properties as indicated on our site's "Trip Details" pages and in Your Final
Documents. However, We reserve the right to substitute
alternate accommodations of equal value if situations beyond our control arise.
In all cases, We will do all possible to alert You of these
changes as soon as possible. Note that in most instances, hotel rooms are not
available for tour participant check-in before 3:00 p.m. On some nights on some tours where overnight train or tent ("ger" or "yurt") accommodations are provided, single or double occupancy arrangements and private restroom facilities are not available. In these specific overnights, shared occupancy accommodations and restroom facilities are provided.
Itineraries: There may be instances where we may need to
alter published itineraries due to situations beyond our control. These changes
may occur before Your tour departure date or during Your tour. Wherever
possible, We will do all possible to alert You of these changes
as soon as possible.
Pets: We're sorry, but pets are not permitted on our
tours.
Special Diets: Tour participants are advised that special diets (i.e. dietetic,
diabetic, low-sodium, low-cholesterol, vegetarian, etc.) are generally not
available on our tours. However, when making Your reservation,
we suggest You advise Your reservation agent of any specific
dietary requests You may have. We will do our best to accommodate Your request.
Single Travelers: A Single Supplement fee of the per
person, double occupancy price applies to single travelers.These applicable
fees are presented on site below each tour's "Tour Dates & Pricing" table. On some nights on some tours where overnight train or tent ("ger" or "yurt") accommodations are provided, single occupancy arrangements and private restroom facilities are not available. On these specific overnights, shared occupancy accommodations and restroom facilities are provided. The Single Supplement rate for applicable tours reflects these accommodation arrangements.
Smoking Policy: Smoking is not permitted aboard motorcoaches. Aboard the
Yangtze River cruise ship, smoking is permitted only in designated, outdoor
areas. Within China, hotel, restaurants or other indoor venues may or may not
observe smoking or non-smoking facilities or areas.
Tour Manager: Tours of 6 or more participants include the services of a Tour Manager, Local Guides and Drivers. If participation is less than 6 guests, your tour will utilize the services of Local Guides and Drivers only. For private, "custom tour" arrangement requests, the services of a Tour Manager will be provided regardless of the number of tour participants, unless otherwise specified or requested.
Travel Documents & Travel Health Advisories:
Tour participants should check with the consulates and/or their local health authority for the latest health requirements (i.e. precautions, vaccinations, etc.) applicable for travel to China, Mongolia and Cambodia.
Passports must be valid for six months after the return date of the trip.
Non-U.S. citizens should contact the appropriate consular office for entry
requirements pertaining to their trip. While we may help and
advise on obtaining these documents, ultimately, it is the tour participant's
responsibility to secure and carry these documents. Accordingly, We
cannot be responsible for any delays, damages and/or losses, including
missed portions of tours, related to improper or insufficient travel
documentation. Tour participants should check with the consulates and/or their
local health authority for the latest health requirements (i.e. precautions,
vaccinations, etc.) applicable for travel to China.
Trip Protection & Insurance: We offer a
comprehensive trip protection and insurance plan. We strongly recommend the
purchase of trip protection and insurance.
Yangtze River Cruise: We do not own or operate the
vessel utilized for Yangtze River travel. C.C.O.T.C., an independent supplier,
owns and operates the Yangtze 1 cruise ship. We act as an
independent travel agent in its use of C.C.O.T.C. as a supplier of this travel
component. Itinerary changes or vessel substitutions are at the sole discretion
of the supplier. Should changes be necessary, We will arrange
equivalent accommodations and do all possible to alert You of these changes as
soon as possible.

| Air Travel Policies:
Airline Flight Taxes and Fees:
Unless otherwise advised by our representative, all normal
governmental and airline taxes and fees applicable to domestic China air travel
as provided within Your Land Tour are included in the quoted total Land Tour
price. However, any additional taxes or fees imposed subsequent to Final
Payment may be invoiced by us. The passenger is subject to any
applicable airline excess baggage fees or excess valuation fees. International
air travel to and from China as quoted and provided by us via
our optional Land+Air program includes all normal governmental and airline
taxes and fees. However, any additional international taxes or fees imposed
subsequent to Final Payment may be invoiced by us. The
passenger is subject to any applicable international airline excess baggage
fees or excess valuation fees.
Airline Flight Name Policies, Reservations and Routings: The name on
Your air ticket must appear exactly as written in Your passport.
We are not responsible for denied boarding or any re-issue costs due to an
incorrect name supplied to us. Air transportation is provided
in Economy Class on scheduled airlines of our choice. Air carrier selection and
routing is at the sole discretion of us, and may include en
route flight connections, overnight air travel, or require en route overnight
hotel accommodations due to airline schedules and/or availability. If en route
overnight hotel accommodations are required, this expense is the responsibility
of the passenger. Final flight itineraries for transpacific travel will be
available 45 days prior to departure and included in Your Final Documents.
Airline Schedules, Schedule Changes, Flight Reconfirmations:
Airline reservation itinerary data, tickets
and E-tickets arranged and provided by us on behalf of "Land +
Air" Program guests are as accurate as possible at the time of Final Document
issuance. At any time, however, changes such as change of airline, flight times
or date, or flight routings may occur. We act only as agents
for the airlines and are not reponsible for these changes. Accordingly,
we strongly recommends "Land + Air" Program guests reconfirm all
flights on all airlines prior to departure. We
will provide applicable airline Name(s) and Record Locator(s) with Final
Documents to facilitate this reconfirmation.
Air Changes, Cancellations & Refunds: Airline tickets issued on
behalf of our Land+Air program may have certain restrictions and
cannot be reissued, revalidated or exchanged. All changes to or refunds for air
tickets issued on behalf of us Land+Air program must be
processed through us. A $50 per-person administrative fee, plus
applicable airline change fees or cancellation penalties, are assessed for any
changes to air tickets once air tickets have been issued, including
cancellation of flight. Airline penalties vary depending on carrier and can be
substantial. In some cases, airline tickets issued on behalf of
our Land+Air program are nonrefundable. Air cancellations provided under the
our Land+Air program are not subject to the Cancellation
Policies as noted in Section 1 under "Cancellation or Change Policies."
Airline Flight Deviations: As an added benefit, We
offer our Air Concierge Service allowing You to customize Your travel to and
from China.
Our "Air Concierge" Service: These services allow You to
extend Your stay in China before or after Your tour, specify a routing or
travel time, specify an airline, request an en route stopover, select a gateway
city not otherwise listed under our airline gateway cities, or upgrade Your air
travel to Business Class or First Class. This service is available for $50 per
person, plus any applicable additional airline costs. Requests must be received
in writing, after the reservation is under deposit, via fax to our Air
Concierge Desk. The service fee and any additional charges are
applied only upon confirmation of Your request(s) by the airline(s) and upon
Your acceptance.
Airlines Flight Delays or Disruptions: We are not
responsible for any inconvenience or any costs or fees incurred by airline
flight delays, lost luggage, cancellation or disruption of air service. Air
transportation is subject to the terms and conditions of the airline's ticket
contract.
Airport Transfers: We include all necessary transfers
between airports, hotels, cruise ship or motorcoaches within China, except as
may be applicable below. Tour participants who purchase airline tickets through
us for transpacific travel for arrival on land tour
commencement date and/or departure on land tour conclusion date will receive
complimentary transfers between airports and hotels. These transfers do not
apply for those who deviate their date of transpacific travel through the
our "Air Concierge" program.
Independent Air Travel Arrangements: Our tour
participants are under no obligation to purchase airline flights through
us. Those who secure independent international air travel
arrangements to and from China are requested to provide us their international flight schedules no later than 45 days prior to tour
departure. Additionally, those tour participants who secure independent
international air travel arrangements are responsible for transfer arrangements
and costs between the international airports and tour hotels, where applicable.
Transfers may be pre-arranged through us at the cost of $40 per
person per transfer.

| Legal Notices:
Responsibility & Waiver:
The owners, operators and charterers of all vessels and transports
("Suppliers") are independent of us. Our relationship with
these Suppliers is that of an independent travel agent. We
make no representations or warranties concerning the Suppliers and we assume
no liability for any acts or omissions of any Supplier including, without
limitation, those involving cancellation of tours/cruises, schedule changes,
re-routings, delay, damage to or loss of baggage, property damage, equipment
failures, accidents, death or injuries to persons regardless of cause, whether
or not any tours sold, services tendered or transportation provided is arranged
through us. Accordingly, You will not have any right to claim
or recover against us as a consequence of any negligent or
willful act or failure to act of any Suppliers or the condition or operation
thereof. Notwithstanding anything herein to the contrary, the liabilities and
obligations of the Suppliers to You, and Your rights against the Suppliers, are
subject to any and all terms and conditions of the Suppliers' contract of
carriage and any and all governmental laws and regulations bearing upon or
otherwise relating to such rights, liabilities and obligations, including,
without limitation, choice of law, jurisdiction of disputes, limitations of
liability and limitations on the time to file claims. By utilizing the travel
services of the Suppliers, You agree that You will look to such Suppliers for
any accident, death, injury, property damage, or personal loss to You or to
those traveling with You, and that neither us nor any
representative of us shall have any liability whatsoever. No
person, other than an authorized representative of us by a
document in writing, is authorized to vary, add or waive any term or condition
herein, including any term or condition set forth in the preceding provisions.
Omissions: We are not responsible for omissions or
presentation errors in printed materials or Internet sites or in any other
media where such information may be presented; we reserve the right to make
corrections as required.
Passage Contract: Tour participants will be required to provide notice
of the understanding and acceptance of these Terms & Conditions prior to
the issuance of Final Documents. Acceptance of these Terms & Conditions
constitutes Your acceptance of Your Passage Contract.
Submission of Materials to us:
Materials (including but not limited to written correspondence; photographic images,
film or video; artwork; travel journals; and creative writing such as prose or poetry)
submitted to us whether for the purpose of inclusion within the
"Guest Comments" section of the our website or as customer "feedback,"
shall be and remain the exclusive property of the author; but in the submission of these
materials the author hereby grants us a non-exclusive and royalty-free right
and license to use these materials in any medium and for any and all purposes without limitation,
as deemed appropriate by us, with or without credit to the author. Moreover,
by submitting materials to us you are confirming that you are the sole author
of those materials, that they constitute original work or content and that you have full right
and title to those materials upon their submission. For reasons of privacy, "Feedback" - written
or photographic - posted anywhere within our website including the "Guest Comments"
section will, wherever possible or appropriate, attribute the author by full first name, surname initial,
state/province and/or country of residence, as well as tour name and month and year of participation in
that tour. Inclusion of additional, personal information will be attributed only upon the author's
additional, written approval.
Agreement: The payment of deposit and/or the issuance of tickets shall
be deemed Your consent to and acceptance of the terms and conditions as
presented herein.
It is specifically agreed that this agreement is entered into Los Angeles
County, California, and that in the event any legal or equitable action is
initiated concerning the interpretation, enforcement, or breach of any term,
obligation, or duty as contained or related to the terms and conditions as set
forth in this brochure, it is specifically agreed that the exclusive venue of
such action shall be solely within Los Angeles County within the State of
California, USA. This agreement shall be construed in accordance with the laws
of the State of California without regard to conflicts of laws principles. All
claims must be submitted in writing and received by usno later
than 30 days after completion Your trip. Any agreement between us
and any travel agent, passenger air carrier, hotel, ground operator, or
other tour operator shall be valid only when accepted in writing by an
authorized representative of us at the corporate office of
of. If we cancels the trip, it shall have no
responsibility beyond the refund of all monies paid to us by
You.
Time of Presentation: The Terms and Conditions listed are those in
effect at the time of presentation and remain in effect until replaced. These
Terms and Conditions replace all previous versions.
